Shortly before New Year’s Eve last year, Macaulay J in the Victorian Supreme Court handed down an interlocutory judgment in the Uber class action. Interlocutory judgments in civil proceedings are usually pretty dry – they normally deal with technical and procedural issues which need to be ironed out so that the proceeding can continue to final hearing and determination. This judgment does deal with technical issues. But it also sets out, clearly and precisely, what is likely to be the main battleground for the entire class action.
